I140 Approved after I485 denied

Please help to know my status is :(

Submited I140+I485, March 26, 2004
Submited EA/AP
EA/AP approved

USCIS aksed for financial report, Jan 2005
We file late on April 2005
They denied I140 after that

We trying to re apply again with same Labor
Submited I140+I485, July 2005
Submited EA/AP
EA/AP approved
USCIS denied again I140 and I485, August 24, 2005
They sent the letters saying denied I140
They sent the letters saying denied I485 (both me and my wife)

Online status of I140+I485 never changed

We appeal I290B on September 24, 2005
USCIS sent receipt afte that
On November 2005, USCIS sent a letter, says "... above case as a service motion to reopen or service motion to consider..."

January 27, 2006 USCIS approved I140
Letter received on February 3, 2006
Priority Date is April 2003 (my labor was filed)

Online status of I140 is changed now to approved.

But I485 online status never changed even after they sent denial letter. This is my I485 onlin status:

Your I485 Application to Register Permanent Residence or to Adjust Status was received on July 1, 2005. We mailed you a receipt with information about processing. It is taking between 850 and 900 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

I have been max 6 years H1B (May 2004) + 1 Year Extention.

Country of Birth = Indonesia


My question is: what is my real status now ?

- Waiting I485 to be approved (850-900 days) because they re-instate automaticaly ? How if my I485 is closed because of denial.

- I have to apply I485 again ? I have no status to apply this(?)

- Have to leave (180 days) after I485 denied on August 24, 2005 ?

We still have ED/AP valid to June 2006

Be patient, your I-140 was re-opened and just approved. This approval automatically should re-open your I-485 as it was denied due to undelying application(I-140) was denied before. It's USCIS, you can't expect things to happen in a day. You received I-140 approval only couple of days back, now it's time for them to re-open I-485. your lawyer should know this.

Thank you for your reply. Will USCIS send a letter for reopening the I485 ? Since the online status never changed, and the USCIS answering machine on the number says exactly the same with the web.

Do I need to file MTR on my I485 ?

I just do not want to have "out of status" due to 180 days after August 24 2005, and that will be in the next following weeks. :o

My lawyer ? She even trying to ask someone to make sure.

Thank You all. I just got message from my Lawyer that my I-485 is reopen, but my wife's I-485 is still in archives. She will send "expedite request" to the service center to re-open it.
