I140 approvals for concurrent filers

For concurrently filed applications are 140 approvals based on the processing dates of 485? I mean to ask that 140 wont get approved until 485 date are current, is that true? When they say they are processing 140 applications from Jan 7 2005, is it only if you filed 140 seperately??

My 140 RD is May 2004 and 485 Rd is July 2004, filed concurrently (Substitute labor).
Got my EAD, AP approved within a month. Did my FP in Nov 2004. After that nothing seems to be moving forward. ITs been 4 months i did my FP, no news on my 140 or 485 applications.
 
it depends on what category you have applied.EB1 and EB2 are processing I140 and I485 together. For me BCIS has processed depending on current I140 dates.

If your I-140 is not approved yet, then you could make an inquiry as your receipt date (RD) is well passed the published RD date for approval. On UCIS current published dated for I-140 approval date is Jan 7, 2005. You could ask your company or lawyer to initiate an inquiry.

thanks for the reponse guys. I filed in EB2 category. I talked to lawyer and asked her to initiate an enquiry and she says she doesn't want to waste her time by filing an enquiry, because that is not going to do anything. Is there any other way i can file the enqiry??
 
experience letters for I140

Hi,

Please advice me on this situation.

In my labor application, my experience with Company A was noted as from May 2000 to January 2002 and from company B as Feb 2002 to November 2002... and Company C is applied for my labor.

Actaully i was layed off on December 18, 2001 and i have expericene letter from May 2000 to December 18th, 2001.
And experience letter from Company B started from Feb 2002 to November 2002.

so i have gap in my experience letters from December 18th, 2001 to Feb 2002.

Will this be a problem during I140. if i submit the exp letter from company A as December 18th, 2001 even though my labor application says till January 2002.....

please advice me ....

Hi Madhub,
I have applied under EB3 and I am from India. I got my I-140 approved last month. Looking at my case you can say that USCIS need not necessarily wait till 485 date is current to approve 140.

I would say there is nothing wrong in initiating an inquiry. If not approval atleast they might take a look at your case.
