My I140 got approved in the first week of Sept, 05, which I found out from the uscis.gov online status. But neither my employer nor the attorney seems to have received the approval notice so far. This is not a desi company but still I have my doubts about how true it is. After the attorney office called to enquire INS, about a month after the approval date, they were told that the only way out is to apply for a duplicate approval notice filing I824. ( I824 in california is taking 4-5 months).

After that the online status got updated to "On October x, 2005, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283."

It has been over 180 days since my I485 got filed, is it safe to change employer using AC21 without having approval copy onhand. When I consulted a different attorney, he suggested that I better have the approval copy to be 100% sure that the case is approved. However, he agreed he is rather conservative in this regard. Can I directly call INS to double check if its really approved before I proceed. Forum gurus or others with some experience please throw some light on how safe it is for me to change using AC21. Thanks in advance.

I am in exactly the same situation. My employer says he has not received 140 approval notice and will contact INS (not sure if he is telling the truth).

My status says the application was approved in Sept. 485 has been filed for almost 195 days days now.

Could you please tell me -

1. What are the requirements for filing AC21?
2. Do I need the 140 approval notice for filing AC21 or just the SRC# is sufficient?
3. Is there a way I can find out from INS that the case was "really approved"?

thanks in advance!

for your info

If you do not have approval notice in original , you can take printout of online status and can use it as proof of approval.
Best way to reach USCIS, There are tips avl in this site to reach customer service of particular processing center. But in this case I140 is employer petition, they wont be giving you (beneficiary) much inof abt the case. But they can say whether application was approved or not.
If you are confident that your 140 was approved you can proceed with invoking AC21, With the online printout

Online status got changed when our attorney called INS to inform that the approval has not been received. Now the status doesnt say that it is approved. It gives a generic message saying "We responded to your request for more information concerning your case." I doubt if taking a printout of the online status can be used as proof anywhere, because it can easily be faked. I think I should call INS and simply ask if the case has been approved or not. I know we dont need a copy of 140 approval for filing AC21, but just for me to be sure that it did get approved. - Thanks

i suggest you take infopass and go and meet in person. i went and i was told that my 140 was approved. even though i knew that was the case. do you have the receipt notice copy. if your employer gave that to you. that might help. you can just give this notice to the person on the counter. if he/she is a helpful one, they might give you an answer. these 1-800 number folks its tough to get answers sometimes.
