I140 Amendment

Anyone who has applied for I140 Amendment or someone can please give insight into my case.

Applied for I140 through company A (ND 08-11-03), EB3 category. Company B bought company A in begining of 2004 and now Company B applied for I140 Amendment (ND 03-09-2004). My question is whether the I140 Amendment will be treated as a new I140, in which case my waiting period restart from 03-09-2004 or will the atleast look at the I140 from company A, link it with the I140 Amendment and may be approve it? Does anyone know exactly how this kind of cases are handled by BCIS? Any help would be appreciated. The online status for the I40 Amendment shows same exact message as it would appear for a new I40 case.

Amendment word says it all. Your previous 140 will be amended to reflect new employer details but you will still have the ND of the previous 140.

Thanks for the reply. There is no such word "140 Amendment" in the BCIS website message. My lawyers at company B used this word. Anyways, now I've got two case numbers, which one should I'be looking at for approval?

I am also going through the same situation. My lawyer said it depends on the person who is reviewing your papers weather he will put it on same time line or start from begining.
 
What your lawyer would have done is that filed another 140 and mentioned in point 6 of part 4 about aquisition of old company. He/she would have presented relevant documents to establish the fact.

New 140 application will be 'tagged' with your old 140 case file.

If this is what your lawyer did you should get approval based on your old ND. However if your lawyer has withdrawn the case and refiled it - you will track by new case number and you date will be ND of new case.
