I work as Sr. Unix System Administrator,
My company filed my I140 in Feb and I got rejected in May.
The reason given by INS was that The job advertisment did not mention the requirement of Advanced Degree for this kind of job"
My company filed the petition against that with some proofs of other jobs with same responsibilities and other employees qualification.
The online status for the petition says
Current Status:
On June 28, 2004, your I290B NOTICE OF APPEAL TO THE COMMISSIONER was received here for processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.
But the NSC if processing cases of dates afetr July 12th.
Does any one have any knowledge what might be happening with my kind of case. Any idea what happens most of the time.
I have not filed my I 485 till now, should I wait for some more time and should I go ahead and file that.
What happens if again get rejected, what shuold be my next action.
I am very nervous because of lack of knowledge, so any kind of information will be highly appreciated.
