Hi folks,
I have 2 questions for you. If one of you can one of you please clarify
that would be sincerely appreciated.
1. Does TSC stick to the recent
memo asking service centers to adjudicate I140 & 485 together if they
are filed concurrently? Or does TSC approve I140 first and then I485
based on the processing time.

2.Also, if I use a substitute labor to file my I140 & I485, will TSC
consider the Substitute labor's filing date as the Priority date for my
I485 or will the I140 filing date be my Priority date.
Folks who have experienced this, can you please advise?

Regards..

For your question 1, yes TSC does adjuducate the cases together (if they are filed concurrently or semi-concurrently)

When did they started?.

Did any one know since when did they start doing so?. my received date is 01/16/03 No approval/FP yet!!!...

They started doing this as of May 1st 2004. If you already have an approved 140, your 485 is going to be in the regular 485 queue, rather than the concurrent queue.

But be hopful I know a friend who had the same situation but with a receipt date of Feb 2003. He recently get approved.

I would advise you to try to get your FP done by faxing TSC.

Somewhere in this forum somebody gave a fax number and sample letter to request Fingerprint from Texas Service Center. I am not sure how far it works, but I think it worth a try.

Research the FP issues section in this forum.
