I140/485 Concurrent filing

Hi,

I filed I-140 on a substitued LC couple of months back. My lawyer advised me not to file I-140 and 485 together as it is a substituted LC.

Did anybody filed I140 and 485 concurrently on a substituted LC? If so, how was the process? Any issues...

Mine is sub LC

I used sub LC
I mailed on 02/28 and done FP, approved AP and EAD.
They treat subLC as normal case. So don't worry. Get all your papers ready and file concurrent.

I also filed concurrently in EB3 on substitute.
Got EAD ,AP and FP done.
Decision on 140 and 485 is pending.
Lets keep in touch.

Received second FP, scheduled on 6/13.
Received AP docuements from the lawyer on 6/03.
Decision on 140 and 485 is pending.
 
When you file 140/485 concurrently, at what point of time I will be safe if I lose my job?

1. Is it 180 days after I filed 485 or
2. 180 days after I filed 485 and an approved 140.

Good question, much speculation.

1. Is it 180 days after I filed 485 or
2. 180 days after I filed 485 and an approved 140.
3. 180 days after I filed 485 and an approved 140 and 140 has been approved for over 180 days.

I'd say

not safe to 1.
probably safe to 2.
and very likely safe to 3.

To be safe I would try to stay with same job at least until 3.

RFE was for experience letters during the priority date on original labor certification. The notice says "it takes minimum of 14 days to process this case after receiving the resubmission. If you have not heard about this case before 60 days call us at VSC 802----" Also they stated that they will be holding my interim benefits (485/EAD/AP) until their office receives my resubmission. It has been a month and till now no sign of approval.

Is this some thing common message for every RFE they issue.
