I130 Application Questions ..

Hey guys .. Next month I will be submitting an I130 application for my spouse. I have the following questions and I would appreciate your input.

1) My wife visited the US before on a tourist visa. She have lost her passport with the visa on it and I94 number. The form asks for the I94 number and since we do not have it, what should we put for an answer ?

2) My wife obtained an F1 visa to come to school here but she never used it. Again the passport with the visa stamp is lost. How should we handle this?

3) We are both divorced and our divorces took place overseas. I know I need to get the divorce decrees translated to English. After I translate the decrees, do I need to get them certified from the U.S. embassy as an authentic translation of the original or would the stamp from the translation center would be enough?

Is she in the US legally now? They only want the I-94 number if she is in the US now, and they only care about the I-94 she got at her most recent entry to the US, not old I-94's from prior trips.

When you say she never used it, does that mean she never entered the US with it, or that she entered with it but never attended the school? There is a difference; if it's the second it could mean big trouble for her.
 
Thank you Jackolantern ... I am sorry for the confusion. She is actually overseas. The missing I94 number is from her only trip to the US. Since that is her most recent visit to the US and we do not have the number, what should we do?

She never used her F1 visa as entering the country. She got it approved but then could not come back here as she was going through a divorce.

I said they only want the I-94 number if she is inside the US. Since she is outside the US, she is not supposed to have an I-94 because she should have surrendered it when exiting the US. So leave the I-94 number and date arrived as blank, or write N/A.

So she got it approved, but then didn't use it to enter the US? Good. Because if she used it to enter the US and then didn't attend school, she could be banned from the US for immigration fraud.
 
Thank you sir. How about the translating the documents. Do we need to get them certified from the US embassy to be considered legal here?
 
No, they just have to be certified by a company or unrelated individual who is qualified to translate from the given language to English. Make sure the translation is accompanied with contact information for the company or individual that did it so USCIS can contact them if they have a problem with the translation. And also remember to include a copy of the untranslated documents, as USCIS wants to see both the original foreign-language wording and the English translation.
 
Thank you Jackolantern. I am planning on including a copy of the original documents for both of us.I am planning on getting the documents translated back in Jordan when I go there next week. Would that be accepted by USCIS here or I need to get them translated here? I will make sure to include all the contact information for who ever gets the documents translated there.

Don't send any original documentation to the US Consulate, because you might never get those originals back. Copies are acceptable and you can take the originals to the interview. You should read the forms and the guidelines for visa process, because it clearly states that people shouldn't send originals, but copies.
 
I am not planning on sending the originals to the embassy, just wondering if I need to the translated document certified from the US embassy as an authentic translation of the original version or translated copy from a translation service company would be good enough ..
