i want to marry an illegal immigrant.

hi all. new here. i met 5 months ago a brasilian girl. she's 29, and came into the u.s. illegally. i am a u.s. citizen. i can tell you all with all honesty, this will not be a sham marriage. we are in love, but in order for her to fully enjoy her life here, we know she must get her green card, or papers. i have a couple of questions.


1) does she HAVE to report to immigrations in order to go back? (she will be then barred, correct?)
2) can she return to brasil "illegaly" the same way she came here? (without immigrations knowing)
3) does she HAVE to return to brasil?
2) can anything be done since she is here already? (although illegally)
3) if she does succeed in going back to brasil "illegaly" (without immigrations knowing she ever was here) will it be easier for me to meet up in brasil with the k-1 papers, then bring her back?

i hope someone can give me a little light on this delecate topic. thanks. ciao.

long story. from brasil, through mexico, houston then i believe atlanta and the last stop was new york. i believe brasil-mexico was by plane. the rest i'm not to sure. atlanta-new york i think also by plane. yeah, sounds crazy, but it's true.

Yes... if she came to the US as Entry Without Inspection (EWI), then she cannot adjust her status. The point of adjusting as status exist solely for people who have been issued visas to come to the US, but for some reason overstayed their time or got married to their sweethearts, US citizens or other immigrants. So, she cannot file for AOS cause she has no status to adjust in the first place. However, if she was issued a visa, then you can marry her tomorrow and file all the paperwork and you can get her a greencard as soon as her name is cleared and your marriage is proven as bona fide.

Yes, she has to return to Brazil illegally, other wise she will face a long ban for coming into Uncle Sam without the necessary paperwork. So, if she is able to sneak out, then it will be easier for you to process the K1 or 3 visa for her once she is back in Brazil. However, you will have to conceal the fact that she ever came to the US, so she will have to explain how you guys met. So, use your creativity there to win her a visa. However, it will not be as difficult as it may sound, most US consulate tend to deal nicely with US citizens, than anyone else.

You cannot adjust her status in the US, no way and don't listen to any lawyer telling you that her hotness will enable her to adjust her status. In fact, should a lawyer advise you to pay him or her to help you with the case, flee from that lawyer, he or she up to no good. The immigration policy is very clear, EWI cannot adjust their status, and have to return to their own countries, but in most cases, they are likely to be denied any form of visa cause they broke the law. However, USCIS will not tell you this, cause they know you will have no incentive to return home. So, get her out of this country without USCIS knowing about it. Advise, go down through Mexico, and help her to catch a flight to Brazil.

^^^ thanks so much AL Southner. this is what i wanted to hear. i had the same thought. i don't think a lawyer can help here. the only help perhaps from a lawyer is to help me fill out the k-1 forms. u hit it pretty much on the nose, and i believe this is definetly "doable".

Once again, if your gf was issued a US visa, then you can just get married and adjust her status. She doesn't have to go back to Brazil and wait for the K1 or 3 visa, which will probably take 9 months. In 9 months, while in the US, after filing all the necessary paperwork, she could have an employment card in 3 months, and possibly, a greencard in another 6 months. Most of these are determined by the effeciency of USCIS, and FBI name check which I understand are atrocious. It doesn't matter how long she has been illegal or with an expired visa, cause these are forgiven once she is married to a US spouse.

One other thing, people who post on this board benefit from a great deal when they are open with all the facts, cause this board is visited by people who have faced almost every imaginable situation in the immigration process. As such, they are able to share ideas which can be helpful. So, you can benefit from solid advice without paying any legal fees, but while using common sense and own research to carry your case forward. So, should people ask for more information, be open and your case will be cracked wide open and you will be helped.

illegal in brazil, want to make it right

I have a question. I entered Brazil illegally because my visa was expired. It will renew in 25 days but the problem is, I am in Brazil with my passport but technically ” I am not here” because i never got a re entry stamp. I have a valid visa and it will renew in 25 days but what will they say if I leave the country and have no entry stamp into Brazil? I am willing to exit to any country in order to be able to come back in legally… but the problem is, how do I leave with never getting a entry stamp… I want to make it right because I cannot live in Brazil Illegally its not right…. please respond to me thank you! Also I will be getting married to a Brazilian women, April of this year, is there anything i can do with marrying a Brazilian?
