I received my current (and 3rd) I-Visa in Oct 2004 (valid til Oct 2009)
- I obtained the 5 year I-Visa for company A although the Visa has no annotation on it.
- 6 months after I received the visa I began work for company B which broke off from company A meaning I am paid and work for a different company to the one I originally filed for.
- I was told by the US embassy official in London when I received the I-Visa that I could use it to work for other companies as long as I was doing the same job function which fit to I-Visa specification (which I am).
- In the past 4 years I have traveled in and out of the US over 20 times and have always written name of company B on my I-94
- In Jan 08 I entered US and INS official in Chicago questioned me about company B and asked me to write company B's name and address on back of I-94.
- Some sources have subsequently told me that I should in fact have informed INS of change of company in 2004, or even applied for new I-Visa for company B, although have had very mixed information.
- I am due to travel back to London at the end of September and now am worried about the validity of my current I-Visa.
As I see it I have the following options -
a) Travel with current I-visa and hope that the new information on back of I-94 doesn't cause any problems on re-entry
b) Contact INS in USA before I travel and officially acknowledge Company B (which could open a can of worms for myself if they see I began working for company B 4 years ago)
c) Apply for a new I-Visa for company B on my trip back to London in Sept 08 (unsure if acknowledging working for company B for the last 4 years on company A's I-Visa would be held against me?)
