Hi gurus,
Here is my situation. I-485 of both myself and my wife transferred to
local ins office in Newark/Teterboro NJ. Probable reason is that my
wife was arrested/fingerprinted because of a misunderstanding with
a store in NJ. This happened after we applied for I-485,so we couldnt
mention it on the application. She went through the trial and the
judge fined $250 and thats it, there was nothing else. The charge was
\'Prohibited acts\' which is a misdemeanor. Other than this her records
are extremely clean.

We spoke with a couple of lawyers, all of them seem to think it ok.
By law it requires 2 instances of arrest/conviction for INS to reject
I-485 and also the probable sentence should be atleast 1 yr. Lawyers
say that we should say the truth and produce the disposition letter
from the court, when we are called for the interview.

If you know anyone who has been in a situation like this or similar,
please share with us.

The answer is as follows:
If you steal something, and if it is less than 150$ in value and if it is a first time offence, then it is a misdeamemour.
You need to contact your local Bar Association to find a attorney who handles this type of cases and get some opinion as what do in this case. If you want I can give you some information about a room mate of mine who had similar experience some years ago.

If it is a scuffle, and the police charged you, then why did they had your wife finger printed. There are again different lawyers in the Bar Association that can give opinion on this.I can give more iformation only if I know what exactly happened.

It is a pathetic siutation out here, to see pepole voice filthy language to express something. I don\'t even know the person who has posted the message. One cannot help, if you don\'t know the fullest fact. I was trying to help, after knowing the fact completely. It is okay to spell out what has happened, since we dont know that person by face

do you have to mention on 485 if you got into a fight
with someone and were charged w/assult & battery but no arrest or fingerprints?
charge resulted with Cont. w/o a finding and 1 year probation.
Is that charge a crime or misdemanor?
