Please help me! I am a 2005DV winner with 11xxx number. I have a H1B visa expiring on 5/17/05. I already applied for AOS in NYC in December and PAID for all the fees. I received the fingerpringting and biometric notice of action and made a 2/5/05 appointment for it. I went to the INS office in the City, and they did not help at all!! They told me it could take 1-3 years to AOS eventhough I am a DV winner.
My question is, :confused: do you think, I should just "cut my loses" and do a CP in my home county? I don't know what to do, I can't sleep..... Please help!!

You may want to IMMEDIATELY hire a lawyer who can do a “follow up” on your case – I guess you already have a receipt from USCIS. I find it hard to believe that the immigration officer told you AOS would take 1 – 3 years because USCIS (INS) are “instructed to process the DV cases promptly” – but instead of going to the local office in New York to talk to an immigration officer – get a help from a lawyer. ABSOLUTELY DO NOT go to your home country for CP before discussing this with a lawyer. In my opinion, everything so far you’ve done was OK and I do not think you have a reason to worry so much…

I understand your reaction BUT Do not despair. I also had a similar phone conversation with an immigration officer right after we were notified about having been selected in DV. Sometimes they are really not helpful. They are supposed to process your application quickly. But you or your lawyer might have to bug them constantly. Also, why don't you ask KCC if you could still do consular processing? If you have the resources (time, money), why not? CP is more smooth and less risky most of the time.
