I I40 and 3rd stage for the consular processing

Is it possible to file I-I40 and 3rd stage at the same time for the consular processing?

My lawyer is saying it is not possible to file both at the same time


Please advise

When filing I-140 you can either:
1. File I-140 and 485 where 485 process starts along with I-140

OR

2. File I-140 with CP option. In this case, CP process starts when I-140 is approved.

So to answer your question, you can file I-140 plus CP option but CP process will start only on I-140 approval.
