I have M.S., Why did lawyer file under EB3?

Help, need insight about GC process!

- M.S. from US univ. on 2000
- 1.5 yrs. experience before joining current company in 2002
- Filed LC under old process on 03/2005
- Trying conversion to RIR right now, deadline 04/01/2007
- Just found out that they applied under EB3

Is there a reason why? Is there any sense in continuing with this stress? I have already paid over $7000 in total fees for filing & RIR conversion & newspaper ads, and not yet got LC!!
 
EB 2 or 3 is determined by the job requirements, not by your qualifications. If your job does not require MS, then, even if you have it, it will be EB3.
