I have got a big problem. My wife\'s I485 case was filed 3 months after my case was filed. So her notice date is different from that of mine. My I - 485 got approved a month back and I am planning to change the job. What will be the impact of that on my my wife\'s I 485 application. She got her finger printing done recently. Her case is also being handled by present company lawyer. Do I have to transfer the file to new lawyer ? What happens if INS sends any RFE ? What are all the possible problems if I change the present job? I am getting laid off now. I have to find a new job. COuld somebody help me please ??

immi_tiger,

I am also in the same position (actually I got laid off). I have retained a new lawyer to try to talk INS into acting on my wife\'s petition. I don\'t know if he can do anything but I am hopeful he can. I talked to the IIO who says since my wife\'s case was filed much later than mine, her case would proceed on its own with its own priority date and all. That really sucks. One thing that my new lawyer did was he filed a I-130 for my wife before April 30th. So in case her 485 gets rejected later, she can the green card through the 130. I suggest that you also try to file the I-130 for your wife. As you probably know, the processing time for I-130 is about 4-5 years during which time your wife cannot leave the US.

If you get any further information, will you please let me know. Thanks.
