I got this mail from USCIS for my wife's 485 case. I guess this is RFE. Please let me know if I am wrong.

"Application Type: I485 , Application to Register Permanent Residence or to Adjust Status

Current Status:

On July 28, 2005, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283.

This raises one more Q, if they are not approving any EB3s then why are they sending RFE. My understanding was they only pickup the cases when they think it is time to decide on our case.

Good question. What I have learnt is that they are still working on EB3 cases but will not approve them till October. I guess they will process the case all the way till they are ready to approve it and then put it aside after marking it as "ready for approval". Once October rolls around they will then go back to all those cases and simply approve them. This is my guess of what is going on. I know for a fact that they are working on EB3 cases. Infact I read a post yesterday where a EB3 got approved on the 29th of July. Not sure if that is true but the filer claims to be EB3 .. I guess anything is possible.

My stupid lawyers did not include my wifes I20s in her 485 applicaiton. Both me and my wife completed our undergrad degrees in the US and have been here for a long time. When we filed for our 485 my lawyer included my I20 but forgot to include my wifes. When they went through my wifes case they were confused as to why she has been in the US for 7 years while her work started only 2 years ago. They wanted to make sure she was in status before she begain her employment. Had my lawyers sent the I-20s, they would have looked at them and figured out that she was a student. Without the I-20s they did not know if my wife was legal or not.

My lawyer handled the reply. She sent out her I20s, latest I94, photocopies of certain pages of her passport that had entry exit stamps and also inlcuded a cover letter explaining everything.
