I got RFE for special registration, please help...

I'm in the process of getting my GC, I overstayed my visa and didn't register when they have the special registration. Now they ask an RFE for a proof of registration. My lawyer told me to go to the immigration office and register now but she said there is a possibility that they would put me in jail and deportation proceeding. Any advice or anyone experience with this before? Thank you.

What do you mean by special registration? Can you explain?

Why is your lawyer asking you to go? He/she should come with you. After all, that’s what they are for. You are paying them enough…use them.

Also, as far as I know, special registration program has been scrapped. I am not sure if it can still be held against you. Even if it does, you cannot do the special registration anymore because the process was considered a huge financial burden for homeland security and was not pursued anymore.

At any rate, you need to get your lawyer involved. An AILA affiliated lawyer has better information regarding this type of information. I bet your lawyer is not AILA affiliated.


Ari4u, Special Registration was started for males between ages of 16 and 45 who were citizens of a certain countries who live in the US regardless of their current visa status. This was part of the new entry/exit program launched at all international airports in the US.
 
special registration like 245(i)

they probably asking you to proove your qualification under a special registration like the 245(i) one of the special rules where to be registrated before april 30th 2001 .
 
That is the special registration program that is in effect for citizens of certain countries, during the recent years in different times they have change the list (which is continuely changing). "This system has two separate portions: port-of-entry registration and domestic registration. In each case, the registree is required to be fingerprinted, photographed, and interrogated. In addition, they are required to provide detailed information about their plans and updates to the US Immigration and Naturalization Service (INS) in case of changes in plans. They are also able to travel to and from the US via certain ports only."

Even for people who enter the country before the special registration they should register, failing to do so can cause serious problems.

From which country you are and why you didn't register if you knew about it?

Philaug28, you are misunderstanding the special registration with the FILING before April 2001 for adjustment of status under the section 245(i), please read carefully. It is not the same thing.

I still don't find the part that is abolish, the website states that the DHS will contact the alien and the 30-day registration is now not needed.

No kidding! there are some cases out of this forum that are like WHAT? I have no idea what to say, scary...talking about affidavits, philaug28 did you sent already yours? :)

Yeah that special registration I thought it was from last year, wrong, it was long time ago they just have been changing the number of countries.

Just imagine without the internet how we wouldn't be able to find things, just call and go to libraries? oufff

Sorry to hear it. You must discuss with your lawyer and provide a good reason to INS that you failed to show up for the special registration. The consequence could be serious. Definitely have a lawyer and a family member to go with you.

I would send them on friday since i have to reunite all the document and additional supports . thanks again . As i understand the case would not mouve if they don`t receive the RFE requested .

Just FYI : I was asked the same question. I was born in an NSEERS targeted country, but I am not a citizen of there and never was. So I provided all proof that I was not a citizen nor a national of that country, proof of my parents citizenship and various other proofs to show that my country of birth has nothing to do with my country of citizenship and nationality. This was asked when processing my EAD card. And after I send the proof back I got my EAD quickly. However, are you a citizen/national of a NSEERS country? I know they laid off that registration scheme, but didn't take away the penalty for not registering away yet.
