I got an RFE

:( Unluckily I got an RFE today, That sucks cuz I am waiting for my EAD so eagerly and it means my case will be delayed.
It asks for the 2005 tax return, w2s and employment letter. What should I be very careful this time, besides sending them as soon as possible? Any details I should be very careful, Actually I am shaking now, freaked out
How long will it delay my case, generally?
btw, I got the RFE for my I485, not I765, any differences?

Your case will be put on hold till USCIS receives the information they requested from you. This means that you have to respond as soon as you can. An RFE puts the I-485, I-765, I-131 on hold till your response is received.
 
I got exactly the same RFE. By the time we sent in our paperwork my husband didn't have the 2005 tax return but since it asked for the last one, we sent the 2004. They also asked for an employment letter, which we DID submit with our original application, this just makes me think they just have this generic RFE that they don't even check if you have one or the other. We sent both things right away and are still waiting. I am also very worried that it will delay my EAD and that I can't get an iEAD till 90 days after the RD of the requested documents in the RFE.

I have an infoPass appt tomorrow to see if we can get any good news. I'll let you know how it goes.

For now just get everything ASAP, especially the employer letter since some HR departments are very lazy.

I read the yellow letter again after calming down. I think my case is a little bit different. Here is the letter:

"......
F (11) We are unable to determine if your household income meets or exceeds 125% of the federal poverty line for the household size claimed on Form I-864 based on teh documents submitted with Form I-864. Submit proof that the petitioner's household income meets or exceeds 125% of the federal poverty line. If the petitioner's household income doesnt not meet or exceed 125% of the federal poverty line, you must obtain one joint sponsor whose household income meets or exceeds 125% of the federal poverty line for the joint sponsor's household size. If required, the joint sponor must submist the documents listed below and a completed and sign Form I 864.

*Federal income tax returns and W-2s for the most recent tax year or certified Internal Revenue Services copies. ........

* Evidence of current employment or self-employment including a letter from each employer on business stationery, showing beginning date of employment......"

My case is: My wife didnt make more than $16,045(household number: 2) for 2005. She made $12,500. So we used the formula (16045-12500)*5= around 20000 to calculate the amount of savings we need. In our I-864, we have 2005 tax return, but no W2s and Employment letters, one bank letter which has 21,000 savings, and 2004, 2003 tax returns and w2s. I simply forgot to put the 2005 w2s inside and as Payala said, the employment letter was very hard to get from her company's HR and we didnt wanna wait forever.

Here is what i am gonna do:
Copy the I864, 2005 tax return(again), 2005 W2s, Employment letter, and Bank letter (copy again)
Explanation Letter (show the formula and how those numbers show our income meets the 125%

Will it be OK then??????

One more thing, I had more than 18,000 income last year as a Teaching Assistant but I didnt include it cuz we just married on Dec and havent liven together for more than 6 months. Should I try to send my 2005 tax return, W2s and employment letter this time also? Or I would just confuse them.
Btw, we filed single for 2005, another minor mistake :(

Or I will try to find a joint sponsor, maybe her parents, but we really dont wanna bother others.

Any suggestion will be greatly appreciated.
 
Oh I guess it is different.
Well my husband didn't make enough 0n 2004 because he was still going to school, that's why we included the letter from his employer saying that he started to work on june 05. In the 2005 tax returns he did make enough. Are you still working as a TA? If you are, you can put yourself as a co-sponsor but you need to fill out another form for that...I don't remember which one. Anyone?

It doesn't matter if you were already married or not when you filed taxes, it just matters how much you're making now (or 2005 tax returns).
 
Payala, what does ur RFE look like? Did it specify that they need 2005 tax return? Mine didnt say that as u can see.

My lovely wife started her current job after graduation Aug 2005, that is why she made so little money:(

I am still working as a TA, same thing, we havent lived together for 6 months yet, so I dont think I am qualified as a co-sponsor.

Things happened just so weirdly, I just got a phone call from a company responding my interview of summer internship. I passed, However, Cuz I cannot get the EAD in the near future(before May 15th), I have to decline that offer, It stinks, REALLY

I posted my RFE under the other thread.

I think the letter from your wife's company is the most important thing right now, since I bet now she def makes more than enough money.

I don't think it matters if you live together or not. Someone else needs to jump in and answer that one since I don't know anything about co-sponsors.

I have already accepted a job offer and I HAVE to start on June 12th. We even moved our wedding day earlier so that we can get an iEAD in case we needed it for June. Now with the RFE I can't get an iEAD till July!!! We have almost the same timeline so my guess is that if we're lucky we will get the regular EAD around May.
 
yes, she makes more than the required. and luckily, she got an promotion a while ago and we found the letter she got from HR, has some information which USCIS requires, such as business staitionary, begining date of employment, type of work.., seems good enough.

I read the I 864A again, word by word, but I still hope somebody else can help me on the co-sponsor thing.

Payala, Better luck on ur case. I just lost an internship chance from a dream company, but that is nothing...
