I got all forms ready to send except I-864 & I-864A cuz lack of evidence

Dear All,
I finally got all forms ready to send in the last second.

But I just found out, I-864 I need to provide my tax return transcrip (still need to request through IRS) :eek: , and all my W-2 forms are not available where I live right now, I need to go back to my parents' house to get them (which takes another week I can find time to do that.)
But I need to send out all the forms before my wife's OPT after 60days expired (3/10). Time is really in a rush for us now. :(

Should I send I-130/I-485/I-765/G-325 without I-864 & I-864A for now? :confused: Then can I send out I-864 & I-864A afterward? I guess USCIS will send out RFE to us for our I-864.

Will that be OK? What should I do now? Please!!~~~

You don't have a copy of your last income tax (i.e. 2004?) You should, and if you have it just send it along with the I-864 and if CIS needs more evidence you'll hear from them ;)

Unfortunately, I don't have any of those document in hand. I need to go somewhere else and get it. And that takes more time when the deadline is very close.
And I am sorry that I am still not sure if I understand your answer there. So I still need to know: if it's OK that I send I-130/I-485/I-765/G-325 without I-864 & I-864A for now, to just make it to the deadline.

my 2 cents

talk to the ISO of her school, they could be a great help. To my understanding, they report to SEVIS about the students' status periodically, and they could defer reporting someone's out-of-status ( they did it to me, so I got 2 weeks extra time). At the mean time, call IRS to get the tax receipt copies, it takes up to week. Good luck.

I hope the other guys will correct me if I'm wrong, but why don't you send all the forms, including the Affidavit of Support without the copy of the income tax, and later they will ask for your tax transcripts.
Generally, what I don't like about incomplete filing (missing evidence) is that it gives them (CIS) an excuse to delay things.


P.S. To answer to your question, I don't think they will accept your I-485 without the Affidavit of Support.

The Affidavit of Support without the supportive documents means nothing, is like send the I-130 without your marriage certificate.

If you send a file without the proper documentation will give you a RFE and of course with all cause will delay your case. And the delay can means a lot when it comes the time to get your EAD on time. If you are looking for "yes it is okay to do it" or "no, you shouldn't". For me, you should not. But is my personal opinion and I think this should be only your call.

I think you still have time (Marth 10th right?) but I don't know how far your parent's live from you so I am just assuming. You can go to your parent's house get your 1040's and W2's if is necessary and make a copy, get your I-864 notarized and that's it. Now, is something else that you need to gather? Do you have all the information of your co-sponsors? Did your wife make already her medical I-693?

I was thinking abot this. Until March 10th there are 20 days, even by mail from almost any country outside of US, you can get a letter in 20 days.
 
They has only 20 days left, and NOA sometimes takes half a month, so they need to get the tax receipts and mail everything out and need to be put in the INS computer system before Mar 10th.
 
Thanks everyone. It's been great help with all the answers provided. I will try to rush to get all our evidence ready (including 1040's and W-2's) and send it out with "ALL forms". Hopefully everything will be done before the last second.

Cherr- Yes. My wife just complete I-693. We're almost ready to send everything except getting my tax information.
