Hi,

Did concurrent filing for I-140 and 485 at VSC and RD is Dec 16th 2002. Got EAD in Jan 2003 and it is valid up to Jan 15th 2004. Applied for EAD renewal on Oct 8th 2003 and pending since then.

Can I get Interim-EAD as its pending since more than 90 days? Actually I am not using my EAD and still working on H1B but applied for renewal (because my I-140 is still pending at VSC). What is the use with I-EAD? If I ignore I-EAD and wait to get EAD renewed is it OK? What happens if some gap comes between two EADs...Please advice...

As far as I know,Technically you can get I-ead after 90 days but I think it has any value only if u r using it to work in US,else if you are on h1b, then it doesn't matter if you get it 3 months from now also.

Not sure what could happan if you have any gap in 2 eads,but based on INs rules on other applications,since you have applied ur ead and it still pending then i guess it should be ok,any correction guys ?

Actually there is no problem if there is any gap in EAD as long as you have a job and H1B does not expire. But it will be very critical
if you loose your job. If I-485 is pending for more than 6 months
(even if I-140 is not approved) the ambiguity of the AC21 portability rule allows you to stay legally here for 240 days.
(my attorney told me this). By chance if you loose a job and get another job immediately then you can use your EAD or one has to file for H1B immediately. I would always say that it is better to
have EAD in hand even if you have a valid H1B.

Thanks Sekar for your comments. I will try get I-EAD tomorrow. I understand from your suggestions that its nice to have EAD without any gaps even though you do not use it.

You are saying that if one have EAD with them...they can get another job even though I-140 is pending. Is that true? On what basis the new employer take the person (status)? Using I-EAD is it possible to do like that?
