I-EAD - Urgent Help Needed!!

Hello Everybody,

My current EAD is expiring by March 31st. I have applied my renewal ( 3rd time) on Jan 12 Online. Even though TSC is processing cases as of Feb 5th, My case status still says 90-120 days. I am losing hopes that I will get approval before March 31st. I am thinking of trying for I-EAD at local office. But, I am not completing 90 days before my expiry.

1. Can someone please post what is the procedure to obtain I-EAD at local INS office?


2. What are the chances of getting I-EAD before 90 days??? Any one out there who haapen to be there in my situation?

3. Worst Case Scenario: if I don't get approval and don't get I-EAD, what are my options.

I sincerely request fellow members to post their valuable suggestions. I greatly appreciate all your help.

As we all learned abotu E-EAD exp .... many ppl shared their painfull situation and exp........

Kamal you should have submited atleast 150+ days before expiring..... in Oct 2003.....

Now....... to solve ur current issue........

my opinion is just get printout ........ of current processing time..... of TSC.....from Alia site...... with ur receipt....... + whatever ur online printed doc whatever ..........

Just go to local INS Monday 22...... and tell them that u ar here for interm EAD...... blah blah...... they will let u in...... when u talk to officer let him know that you talked 800 No and discuss interm EAD...... blah blah.... Here is TSC current processing official Time .... mine is expiring...... on blah blah date....... pls help me out in this.......... and say it very very super nice way.............. I hope they would understand and your prob will be solved.........

if u are thinking not to go and try...... hey Kamal..... you don't have any option left.......... pettition was submited late.... E-EAD had issue........ why just sit at home and regret.......... just be hopefull go and try .......and see reusult....

1.You can go to your nearest INS office with the following documents.

a. New 765 application.
b. original pending 765 receipt
c. copies of I-485 and I-140 approvals.
d. previous EADs and a copy of them.

Depending on the INS office you might get EAD on the same day or get an appointment for someother future date.



2.Unfortunately the INS offices are very strict about the 90 day rule. Its very rare that they issue iEAD for these cases.

3.Unfortunately only option is to take unpaid vacation. You can try to switch to H-1 (premium processing) if it works in your case.

I was lucky

I would have been in a similar situation. But my EAD got approved on 12 th March. It was applied for on Jan 29th. My current L1 is expiring on March 29th. It was not filed online.

I am extremely thankful to you both for taking your time in not only sharing but encouraging words. I will definitely give a try and see what happens. I will follow all your advises.

GC6020, You said to take a fresh I-765 Application. Do I also have to pay in case they allow me to get Intermim EAD? Another thing I want to make sure I understand you correctly, I have to go to the local INS office first. Depending on, either they process on the same day or ask me to come for another day. First time, I just have to go on any chosen date. Is that right?

how do you find the nearest local office for I-EAD ?
I am a TSc filer living in VA now.
I still have time and will start worrying abt it in april but just wanted to know.

I forgot to ask you one thing about what you wrote. You were telling that I can switch to H1. In fact, I have a valid H1 valid till June 2004. But, when I came back from India in 2003, I came back on AP. That time I had a valid EAD until May 2003. I filed I-9 with EAD to my office. Then I renewed my EAD in time and that is what I am using right now. Do you think I can use my valid H1?? I appreciate if you write more info about this. After I read your reply, suddenly i rememberd about my valid H1. I thought, once I switch to EAD, the H1 is no longer valid. Appreciate your reply.

You don't have to pay again for interim EAD. But you need to either submit a new application or a copy of your original application if you have one. Its better to have both, just in case.You can go on any day after 90 days.

I am not sure whether you can switch back to H-1 if you have used AP to enter the country. You need to check with a lawyer or your HR regarding that.

I don't think you can automatically switch back to H1 after you used AP or EAD. I had the same issue after using AP to enter US. I automatically entered Adjustment of Status (AOS) status.
