I can be misreading this link for concurrent 140-485?

That is what this link seems to say. But, it is dated as December 2003, and not sure how much this info is valid now....it is safer to consult ur attorney about this....
 
Believe only what USCIS says directly

I will believe this crap only if USCIS memo clearly says that. Than atleast we have a ground for appeal in case a case like that is denied.

Btw. rumors are USCIS is preparing such a memo where it will spell out the confusion around unapproved 140 and use of AC21 so my suggestion is to hold on to your bold moves till then.

Some months ago, I talked to my lawyer on the same matter and he was not aware of such a memo. Further more, he strongly adviced me in not doing a career move before I-140 is approved.
