Ladies & Gentlemen....

You all may know me very well, I have been here in this forum sharing my pain with Nebraska service center for the last 3 years . A lot of friends here applied after me, struggled for a while but finally they got approved, except for me. My concurrent (I-140 / I-485 / I-131 ) are still pending since JANUARY-2003 without any approval or denay for each of them. My lawyer gave up ! He told me that there is nothing in our hand to do. I have done every possiple thing just to know why in the hell my particulaer applications takeing all that long pending processing :
- Senator Office :Since 2003, Every two months I conact them and each time I got the same traditional reply ( Your case is pending for security checking !! ). Any body would emagine security checking lasts more than 3 years!!
- National Customer Service : tens and tens of inquiries ( and you guys know how long you have to wait until they answer you). Each time I got the same automatic replay ( We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. )

- Sent a letter to the head officer of Nebraska service center detailing all my pain, NO RESPONSE

I am running out of patience . I can not change job for my company is sponsering my GC. I can not travel overseas ( neither my wife ) for I dont have an I-131 approval. My wife can not get a job for her employment authorization not approved. My little daughter ( born in USA) can not travel to our native country to see her grands for her parents can not travel with her. Me and my wife are paying a doubel university tuitions for they treat us as international students not a permenant residents. Letterly, I am out of patience. I am thinking of giving up and going back to where I came from, leaving every thing behind me, the time and mony I spent, my daughter's future, my wife education, my job, and my MBA degree.

I can understand and feel your pain, I am even worse condition because I cann't go back to my country becuase my wife is dentist and she uprooted from our native country leaving her successful practise and had to go to school here (spending tons of money) now if I ask her to go back that will be bummber ....
I wish I can tell you something nice ...but

there is a lot of info about people stuck in security/name check.
If you applied for EAD and it is still pending after 90 days, you can go to local office (make infopass appointment) with EAD receips and get interim EAD, so you can work while I-485 is pending.
I think there is no such rule for AP, but you can try to apply for AP once more.
About name check, it looks like FBI started looking for old cases (see above thread), someone posted they currently work on cases submitted on Dec 2002, so you may be close to approval.
One more thing you can do, file 'mandamus' lawsuit (again see this thread and references in it for info), then USCIS must make decision on your case in 60 days.

Meet me gaiser. I am waiting for my 140 from November 2002, even before you. I crossed the stage which you are feeling now. Cannot give you any advice or direction except consolation. Don't know what to do or what to tell you. In fact I stopped waiting for it.Today I came to this site after 1 month.
 
Can you try newspaper or even better TV. Now with the focus on immigration reform reporters should be jumping on this.

I feel your pain. My sincere prayers and sympathy are always with you. If I were you, I would be talking to my attorney to file a writ mandamus at the earliest. You have no reason to wait anymore. so go for it.
 
Who is up for mandamus lawsuit ?? I don't have any info of it , but if it can help then I am ready for it
 
Try with OMBUDSMAN .............

I am sorry to hear about this and one advise I can give you is to try with OMBUDSMAN office.
I had the similiar problem with USCIS, 485 interview before 140 approval.Than I wrote a big letter to OMBUDSMAN(pls spell check) and after that things moved.140 is approved after RFE. So I suggest you to consider the OMBUDSMAN route and give it a shot.

My I-140 & 485 also got stuck with Background check since April'04.My attorney initiated an inquiry with USCIS 1st week of february and we received letter from USCIS saying that my case is under background check.If we don't hear anything from USCIS within 6 months they asked us to call USCIS national customer service.
