I am on EAD and got laid off before 180 days

hi guys,

I am in a fix now. I have applied my I-485 on April 15th 2003. And I came to know that I will be laid off in the next 3 months. Fortunately I am given 3 more months.

So I am thinking that since I have 3 1/2 months more, lets say after 90 days I get my Interim EAD and I update the HR and technically come onto EAD status and then leave the company and transfer myself to the new job using my EAD. Is this justifiable. I mean since my 180 days has not yet over, would this have any effect on my I485.

I wanted to find out what is the law. I mean lets say I do not know that I will be getting laid off. So in 90 days I got my Interim EAD and got into EAD status right away and unfortunately in the next 10 days, I got laid off. So the 180 day mark is not yet reached. But since I have already got into EAD I will take another job using my EAD. So does all this effect my I485 approval. I mean if I receive an RFE, is this scenario justifiable.

I really need to know if it makes sense to get onto iEAD in the next 90 days before I leave the company and take up a new job on EAD, or get into the new job with a H-1 and I hope that my I-485 will be approved. I am all confused. But I feel EAD will give me more flexibility and stuff.

Dont worry - get your iEAD and get a job quickly... that is the most important thing.. there is no point worrying about stuff not within your control.. just do what you have to do and everything will fall into place... relax you are an educated guy with brain power - the US wants to keep guys like you here....

If the United States wanted to attract and keep educated people "with brains", they would go with a professional immigration program like Canada does. The problem is that the States don't care much about immigration like they used to. DV lottery, chain family immigration, refugees and asylees are the direction they want to move to. Don't forget about amnesties...

Immigration laws are long overdue for restructuring and rewriting. The only problem is that people who want it to happen (namely, us, intended immigrants) have no voice in federal legal matters of the United States. And how many of us, finally received their Green Cards and Citizenships down the line, forget about immigration and even start badmouthing new immigrants?
