I-94 when I485 is pending

Hi,

Our (myself, wife and son) I-94 card is expired on 03/01/2003.
Last year when we went to India , at the time of entry in US, the officer put a remark on I-94 "Parolled in the courty until 03/01/2003". This I guess allowed us to enter in the country on Parol basis since I showed up my parol at the time of entry.

I have my 485 pending since Dec'2001.

The question is whether I should apply for extension of Parol and I-94 renewal ??

Is this required ? (assuming that I don't plan to travel prior to Approval of I-485)

Am I already in trouble ?

You should definitely extend your AP even if you have no plans to travel abroad. It's just for safety sake, just in case circumstances force you to make a trip abroad. As far as I know, once you've applied for Adjustment of Status your I-94 loses meaning. When you're on a non-immigrant visa in the US the I-94 is a document that allows you to remain in the US for the validity of the I-94. Once you apply for Adjustment of Status (I-485) you're allowed to remain in the US as long as your 485 is pending. So your 485 Receipt Notice kind of replaces the I-94 in terms of your permission to stay in the US.
