I-94 stamping/Passport expiring

Hi!

I am planning to go to India on March 29. I have a valid H1B visa in my passport. The H1B visa expires in December 2005 but my passport expires earlier in June 2005. When I re-enter US (sometime in April 2004), what would be the validity of the I-94 issued at that time? I heard that, in such cases, they are currently issuing I-94 valid only till expiry of passport. I feel, this is not correct, because I plan to get my passport renewed when I enter U.S.

Has anyone of you experienced this or has any more information on this?

Thanks a million!

P.S. I know this is not the most appropriate forum for this question, but I thought most of the people here must have experienced a similar situation and I would get a valuable feedback.

I returned from india 3 weeks ago( on feb 25th) on Advance Parole. The immigration officer stamped Feb 24th 2005 (one year from date of entry) as the validity of my I-94. My passport expires this year (Sept 2004) and my Advance parole is valid till July 2004. Hope this helps , though others may have different experiences at the port of entry.

Usually the immigration officer is bothered about the expiry date on the Visa and not of the passport. You can apply for renewal of your passport in US itself by going to one of the Indian consultes. If your visa stamping is in the old passport, you need to carry both passports whenever you are travelling. I had the same case and faced no problems.

For Indian passports:

Any way possible in which one can get visa stamp transferred to new passport?

If visa validity is over - can one trash old passport or are we supposed to carry it always?

Great to see people thinking about still continuing to have visa for next 40 years :) I don't blame you guys..It is BCIS that us all think this way..Hope we all get our GC's by then.

Anyways, once you have some proof of valid immigration in the new passport, you can always thrash the old one (unless we want to show the immigration guys our smart unbalded faces, ten years younger)

100% sure i-94 stamp according to visa or any other. abosultely not passport validity(off course you should have valid passport).

try entend your passport, you can always go to local Indian embassy also to get passport extended.
