I-94 return date

Hi,

I couldn't find a place on this forum to post my question. I think this is the best place. So please bare with me.

My Brother is here for 90 days only just to visit. He has a round trip ticket issued by Delta. His I-94 was stamped on March 23rd 2004 at LAX. His return date on his airline ticket is June 22nd 2004. We realized that it will be 92 days on that date. We are trying to change the date to at least June 20th(90 days) or earlier than that and we can't find anything. Delta said that the ticket has restrictions on it too so most likely he would have to buy a one way ticket to go home and it will cost us A LOT of money in order to do that.
How bad is it if he leaves on the original date of June 22nd and end up being here for a total of 92 days? Is there anything we can do with the INS? They actually pointed that out to him when he got in the country and suggested he cahnged his return date. We are not trying to change his return date to extend his stay. Worst case he will leave on the scheduled date but will he have a hard time next time he wants to come here to visit? Any suggestions? Thanks.
