I-94 Question

Hello
I have a question relating to I-94 validity.My previous I-94 on my passport was till May 2003,however the I-797 i have currently is valid till april 2004,and i am applying for my H-1 B extension via premium processing tomorrow.My last date of entry into the country was Dec 2000 when from my previous 797 the passport was stapled with a I-94 till my previous approval notice date.
I want to make sure that i since i have not travelled and the I-94 on my current I-797 is valid i am fine.
Quick response would be appreciated.

Not sure how many I-94s you have since your entry. If you have only one which expired may 2003, you have a serious problem --unlawful presense more than 180 days. If you have more than one I-94s and the most recent one has not expried, you are fine.

Please Help !!

I am in similar situation.

1) My previous I-94 on my passport was till Feb 2000
2) the I-797 i have currently is valid till April 2006 (Previous I797 is valid till March 2004, I did a H1 transfer from that company)

3) My last date of entry into the country was Feb. 1999 when from F1 student visa the passport was stapled with a I-94 till my student visa approval notice date (Feb 2000).

4) Should I try fr H1 visa stamping in Chennai saying that I was legal to stay in US since my I94 says March 2004 (or APril 2006)...
I have paystubs/W2/tax forms for 2003 (+ all supporting docs from lawyer and my company) OR

is it safer to try for a BUSINESS TRANSFER visa (L1) as my company has a branch in Bangalore too....

PLEASE HELP!!

The current I-94 on my I-797 is still valid,since i haven't travelled out it's not on my passport.The I-94 number is the same as the previous one.
 
califnik: Look at the bottom of your current I-797, you should see an I-94; if it is still valid, I do not see any problem in visa stampping.
