I-94 issues with H1 extension and travel

Hi,

My first H1 expires Jan 20th 2005. I have an H1 extension approved from Jan 21st 2005.
I need to travel to india the last week of December 2004 and return second week of Jan 2005.
I was not able to get an appointment in chennai(all dates booked according to ttvisas). I will be back before the first visa expires, but is it safe to travel?.
What I94 do I use for my departure record? When I reenter US what will be my ne I94 valid date.
I will have the valid extension document with me(I-797) but no new H1 stamp.
Will I get I94 with the same valid date as my extesion? Or will the new I94 using old visa(still valid) invalidate my H1 extension. Please Help.

No problems at all ... technically you can enter the US even on the last day of the visa stamp - no issues.

The new I-94 date **SHOULD** match the date on your approved 797 (H1 extension).
You MUST make sure of this .... you MUST show the new 797 alongwith your passport - don't show any previous 797 -- just the latest.
Again - check the I94 dates before you leave the immig desk -- if they make a mistake, they'll fix it right then.

You'll give back the old white card I94 alongwith the copy of the I-94 that came attached in the bottom of the H1 extension approval notice when you leave.
 
Give Both I-94 Cards while going...

You should surrender both the I-94 cards.. the old one and the new one which came with the approval to the airlines people while going.. and show the new approval to the immigration officer while coming.. he should give you the I-94 card with the new expiry date..
 
hi guys had a question.
our h1 and h4 renewal is coming up ( 6th yr ) in may 2005 . we are planning to apply it from now only since its taking approx 4 mths to get the approval notice.we have a valid stamp in passport till may 15 2005
meanwhile if the spouse travels to india and to avoid the stamping hassels is it ok to return back a few days before the 15 th of may (around 10th may.)?
will the fact that the visa stamp in passport is expiring in few days create a problem at port of entry.she would have the approval notice though .is that sufficient.?
