I-94 issue

Hi gurus,
         Recently i have sent my 485 documents to my attorney,
today morning i got a call from him on my I-94 validity.
I came to US in March 1998 and my visa was valid until Nov 2000.
some time in Oct 1999 my company filled H1 extention and it got approved.
I went to India in Mar 2000 and came back on Apr 4th 2000, at the port of entry
they have seen my passport and issued I-94 valid until Nov 2000 based on my Visa.

I have sent my new H1 ext for re-validation in Oct 2000 because my old one expires in Nov 2000.
What is the point in showing New H1 papers when my old H1 is valid until Nov 2000 at the port of entry
when they did not even asked.
My attorney says i have expired I-94, even though i have expired I-94 i have valid H1 and which
is been re-validated.
It doesn\'t make sense to me why is botherd about date on I-94.

Michael Aytes (INS Assistant Commissioner) wrote a memo a few years ago that addressed this situation. Get a copy of the memo from your attorney and go back to the port of entry and have them correct the error (they\'ll issue another I-94 with the correct validity date). If they refuse, you need to go to the district office with jurisdiction over the port of entry and they will correct the error.

Your case is a bit trickier since your I-94 has already expired. It\'s still only expired due to an INS error though.

Undeliverable I 140

Hi All,

My 140 has been approved on March 20th. My Employer got a courtesy copy,But the original to to attorney has been returned as undeliverable by post office to INS TSC.This is the info from AVM.
My Attorney says it may take another month from now to get the 140.
Is there any other way to get it sooner than that?
The TSC line seems to be busy (engaged) all the time, during regular hours.
Can any body shed some light?
