I-94 for H4 holder

My wife is H4 visa holder. she received H4 approval notice from the INS and but not I-94. My company's attorney filed her papers, I think he might have got it but he did not send I-94 paper to me. Now we got EAD and travel documents.

My question: Is her H4 approval notice enough for getting Green
Card or does she get any problems at the time of approval of I-485? I am thinking of filing I-102 for duplicate I-94 but I am not sure whether INS mailed I-94 to attorney. I do not want run into trouble by claiming that she lost I-94. Attorney is not giving me any information whether he received I-94 as he was fired by our company.

What do u suggest me folks.... Your suggestions are highly appreciated.

One Copy will have it..

INS will send 3 copies:

1. Acknowledgement copy for you, whic will show name and DOB; but NO I-94

2. Copy for Lawyer, which will have I-94 at the right-bottom.

3. Copy for Company

So, please collect the second copy form the lawyer.
 
Paccha, thanks for your response. I am talking about H4. Company is nothing to do with H4, of course I paid fee for it. I got acknowledgement of H4 as you said. I-94 might have gone to the attorney as he mentioned his address in the papers.

The present attorney of the company told me that in absence of I-94, INS treats alien as an illigal resident (inspite of H4 approval notice) and INS may fine 1000.00 at the time I-485 approval.

I am confused, how can H4 visa holder is an illigal alien when there is H4 approval paper but not I-94.

I-94 is there for H-4 also

I have got it for my family..

1. If lawyer has give the address, he will get seperate H-4 for spouse and chidren, with I-94 in that. Every individual gets seperate H-4

2. Once you filed I-485, your stay is legal ( including depnedants). Your dependants will have expired I-94 attached to the passports. Just give it to them at the time of stamping. ONLY concern is that at the date of applying for I-94, you must have I-94 for dependants, with valid dates on it (I mean, NOT expired prior to that date-RD of I-485). Once you file I-485, your status is "Applied for and Pending Decision"). That is the reason they sanction you AP.

3. Once you applied for I-485, you should NOT stay away from the country for more than 3 months, when status is pending.
