I-94 expiring soon

Hi,

My I-94 expires this week as the immigration officer gave validity date based on my passport expiry date ( Aug '07) and not based on H1-B visa validity data ( Sept '08).

I have applied for I-485 in May'07 and I have the reciept from USCIS.

I want to know my status after my I-94 expires. Will I be out of status or will I be under " AOS pending" status.

I will be in the similar situation soon, I-485 filed and I-94 based on H-1B will expire (in a few months). I will be applying for EAD etc. My lawyer says that I don't have to keep extending my H-1B.
