I 94 expiring in Nov 03.

Hi,

I was just reading a post here about expired I 94. I have an approved 140, EAD and AP valid upto Mar 04. My 6th year H1 limit is expiring on Nov 03. I don't plan to file for H1 ext. since it is another 3K expense. So does that mean being my I 94 expired, I need to get another I 94 i.e. stamp of EAD/AP in passport? How does this work?

Any help is appreciated.

Do not worry, you are fine in all respect and you do not need to renew I 94.

AP is good for overseas travel and EAD is good for working ! Since your 485 processing is going on so you are in status , no need to file H1B ext.

My example, my I94 expired in Nov,02 and I travel to India on AP on Feb 03, without any problem !

I-94 should be valid till you file I-485. So you are in status. No need to worry about I-94 expiry date after you file I-485.

You will get new I-94 if you travel using AP.
 
Just make sure you file i-9

If you haven't been working on EAD then file I-9 form to start working on EAD.
