I-94 Expiring in 10/10 while upgrading from EB3 tp EB2

My I-94 is expiring in Oct 2010. I am in process of upgrading from EB3 to EB2 category. I am also on my EAD right now.

Does anyone know if i have to go back to India to get a new I-94 before it expires or can i stay after Oct 2010 where the I-94 will have expired by then?

please help.
 
I presume you have filed an I-485? If yes, then it doesn't matter that your I-94 has expired. A properly filed I-485 gives you legal authorization to stay in the US as long as it is pending.
