Got married to an american citizen, now I'm about to fill my green petion. My status is visitor but my I-94 expired.(it was only for 3months). I'm european. If I fill my petion...am I gonna have any problems? what can I do?

Bu the way....anyone knows anything about I-131? I would need to leave the country for xmas...times, is it easy to apply for? any suggestions?
