I-94 Expired ...Please Advise us..

Hi all,


My sincere apologies to all the members for having an unclear posting earlier.I had done that in an anxious state of mind.


Nov 2000 my employer had applied for my H-1 extension.He did not inform the lawyer about my dependent.My I-797 was approved and we filed our 485 .
Then to get our passports stamped we sent them to St.Louis .

The passport has been stamped with the new visa.

My wife's 94 expired in Nov 2000 but she has her visa until nov 2003.

We are expecting our approval anytime and my question is can we go for stamping ( to Newark) with the expired 94. Is this going to create any problems?

Is it better to cross the border and get a fresh I 94 before that?

We just moved to a different state and the DMV refused to change her license since the I 94 expired.That is the reason we are having concerns now.

Your response is greatly appreciated. Any suggestions please?

As long as you are in valid status, (AOS / H1B/ H4)
you don't have to worry abt that at all. This is for stamping.
But DMV will issue the license only upto the validity period of your
Visa (this is only in certain states) My I94 expired last year and I moved to MA and got the license which is valid upto 2005.

But for stamping you don't have to worry abt that.
If you have any issues with DMV or if you are afraid of stamping with expired I94, you could go out of the country and get the stamping. I think now you can go to canada and get the stamping on your way back. I am not sure of the procedure though.
