I-94 Expired ...Please Advise us..

Hi all,


My sincere apologies to all the members for having an unclear posting earlier.I had done that in an anxious state of mind.


Nov 2000 my employer had applied for my H-1 extension.He did not inform the lawyer about my dependent.My I-797 was approved and we filed our 485 .
Then to get our passports stamped we sent them to St.Louis .

The passport has been stamped with the new visa.

My wife's 94 expired in Nov 2000 but she has her visa until nov 2003.

We are expecting our approval anytime and my question is can we go for stamping ( to Newark) with the expired 94. Is this going to create any problems?

Is it better to cross the border and get a fresh I 94 before that?

We just moved to a different state and the DMV refused to change her license since the I 94 expired.That is the reason we are having concerns now.

Your response is greatly appreciated. Any suggestions please?

Do you mean that you have a valid H1 and your spouse is on a Expired H4?

If you mean to say that the i-94 on the passport has expired but U'r spouse has a Valid Document (797) which says that the visa is valid till 2003...it is safe...

DMV first thing should not refuse if you have shown the Valid Document....and not just the passport.

Remember i-94 is given only when U enter and removed when U go out of USA.

So U may have entered 3 years back and it must have expired becoz U never went out of the country in 3 years.

You NEED NOT go to Canada for a new stamp on the passport....period...And also now it seems the INS entry points at Canad and Mexico do not issue visas for extension. They point U back to the country of Origin.

My wife has valid h4 until Nov 03 stamped in her passport but the lawyer never applied for any 797 form for her.We never sent anything for stamping but still got the passports stamping but all this process went through the lawyer.
I have a valid H1 until nov 03 & my 94 also expired.But when i went to the DMV office to change my id i attached the bottom portion of the 797 form in place of myold I94 & got the drivers license changed.
But they refused to change it for my wife since her I94 expired & she does not have any 797 form to detach new 94.
Now my question is can i go for stamping with the expired I94 ,after my case is approved or is it going to create any problems.
Anyone with any info on this please advise.Your help is greatly appreciated.
