I-94 Issue (Over stay)
Details
Landed US on Company A visa 2000 Nov - Visa valid till 2002 OCT and I-94 Valid 2002 Oct 14
Changed Feb 2001 to company B Got H1 and new I-94 Both valid till Nov 1 2003
I didnt get stamped on that time
mean while went to India on Apr 2002 come back with OLD VISA Company A (Still working with company B)
POE issued me New I-94 with old visa date ie: OCT 2002. even I showed both H1(NEW /OLD H1 Approval )
I didnt realized on that time regarding I-94
Send Passport to St Louis for new H1 visa Stamping on jan 2003. ( on that time old visa expired)
They Issued me New Visa on Company B.
in Sep'2003 I applied new H1 for Company C. On that I come to know my I-94 is not valid
my Company C applied H1 and form I-102 to correct I-94 status
INS approved H1 only and they said You need get stamped (for I-102 reply) in Home country (India).
I came to India on Oct 10 2003( < 1 year of expied I-94 as Old I-94 ie : Oct 14 2002 )
I didnt goto Chennai Consulate for stamping
Now I got joined in Indian MNC.
They are thinkng to Send me US soon.
1) Am I valid or Illegally stayed?
2) If my Indian Company applies H1/L1 do they approve?
3) If they approve Do I get stapmed in Channai Cosulate?
4) If everything goes fine .. (if Visa stapmed in Chennai consulate for New H1/L1 ) will be a problem with POE?
Is there any way I can check wether I am legal or illegal?
5) Am I bar for 3 years?
