I-94 date

Hi,
I got my H1 visa by state department in June (now H1 expires 15 Nov '06)
My passport expires April '05.

Yesterday, I reentered the US. The immigration officer asked me what I am going to do as my passport was expiring in a few months and I told him that I will apply for a new one at the Indian consulate in SF.

He put the new I-94 date also as 15 Nov 06.



I read somewhere that the I-94 date should be the earlier of passport expiration/visa expiration.

Is my I-94 expiration date correct?

That's weird ..... I entered the US once with my PP expiring in about 9 months or so -- I clearly remember that my I94 was marked only till that PP was valid ( even though my approval was for longer -maybe for about 4 months more ).
After renewing my PP, I had to extend my H1 (like usual ) and got the new I-94 with the approval.

I don't anything has changed recently ...

but ultimately, its the I94 date that determines validity of your stay -- so I would say that as long you get your PP renewed, you should be OK till the date marked on I-94.
But check with your attorney as the I-94 date is pretty critical as it directly determines whether you are legally present here.
