This is my current situation. I had my approved visa from Company B which lets me stay until Jan'06. But unfortunately, I lost this original copy. And when I went out of country, I used my Company A visa which was already stamped in my passport which is valid only until Jan'05. So, I currently have my I-94 based on my Company A visa which expires on Jan 16th of 2005. Everyone said that this overrides my Company B visa. I have now submitted my I-824 form to get the copy of my Company B visa. But Im worried that It might not be with me before Jan 16th when my I-94 expires.
Now the problem is, the I-824 form says that it will only reissue the Visa form I-797 and not the I-94 along with it. As I cannot stamp my new visa In US, what would be the possibilities of getting this visa stamped in Canada or Mexico !? Also, how long can I wait in US without my updated I-94 after Jan 16th !?
Im little concerned in going out of the country for stamping and retained outside. Would like to take the safest possibility. My GC is still in State labor probably a month ahead to get cleared. Please give me a solution with minimal risk. Any help would be much appreciated.
