We had our I-94 lost too
I am in similar boat.
Please note that it takes longer than what INS say to aprove replacement I-94. We applied togather. my wife got it in 2 months.I am waiting more than 3 months now and its not yet approved.
In case you are going to apply for replacement I-94, you will need to fill form I-102.
You will get receipt acknowledging your application for replacement I-94. I hope this receipt from INS solves your problem.
In either case , please post your experience at stamping.
I would like to know how they handle lost I-94 cases.
BTW, who is your lawyer. My lawyer says INS take I-94 when U apply for EAD ( which is not correct.. they must have misplaced my I-94). I am trying to find if they are same as your.
