I-94 Amendment (L1 to H1)

Hi, I was in L1 during 2008 and applied my H1 in Apr' 2008 for Oct 1st 2008 start date. Since I was unable to find a job in H1 I continued my L1 status. Also meanwhile I went to India in 2009 and came back. Now i got a job through my H1 employer. Please let me know if I can apply amendment to get my H1 I-94 and join the new job.

If your H-1 has an updated I-94 at the bottom of the approval notice (I-797), you have knowingly or unknowingly violated your non-immigrant status. Please respond whether there is an I-94, to respond accurately to your question.
