I-90 update

All,
I got a letter from USCIS to send in my original GC (incorrect backdating).
So I did that and the letter said that it will take three weeks for them to send me a corrected GC.

It's been four weeks and nothing so far. Questions are:
1. I sent it in using Fedex and I know it's been accepted but the status online has not changed. Is this normal?
2. Who can I call to follow up? The usual 800 number? Or is there a different number for this?

If I recall, Paramvir1 also went through the same issue since the GC was not backdated. Any update Paramvir1 or anyone else with similar issue?

Thanks!

You can search back in this forum and find some posts from Paramvir1 and me. We both went through the blue letter process and received the correct GCs about three weeks. Both of us filed I-90 before this blue letter. Maybe that is the difference. After they received the incorrect cards, our I-90 cases were updated. So were our I-485 cases when closed to finish. I am sorry for your case. I did use FedEx to send the cards back to CIS. For your second question, there is a phone number on the letter that says you can call if not receive the new GC after three weeks past, I think.

qlyus,

What did you mean by " After they received the incorrect cards, our I-90 cases were updated. So were our I-485 cases when closed to finish." ?

Did you mean INS gave you another LIN** number for your I-90 case which is online accessible ?

Did you mean you were not able to access your I-485 case after approval ?
Thansk,

Thansk,

We had pending I-90 cases. They were initially filed online to Missouri Service Center with MSC**. After bio#1 done, they were transferred to california center, then Nebraska center before the blue letter arrived. We received notices on each transfers. Then the blue letter arrived. We followed the instruction on the blue letter and sent the GCs back to NSC. Here is the time line by looking back my e-mails:

On Nov 22, we sent the cards back to CIS via FedEx 2-day delivery. They were delivered to CIS on black Friday.

On Dec 1, we received emails from I-90 cases (MSC#). They say "On December 1, 2005, your I90 APPLICATION TO REPLACE ALIEN REGISTRATION CARD was received here for processing. It is taking between 190 and 220 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

On Dec 14, we received emails from old and closed I-485 cases (LIN**), "On December 14, 2005, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready."

On Dec 16, another emails from I-485 case with "On December 16, 2005, the card order was completed and we mailed the applicant's new card directly to him or her."

We received the correct cards a few days later.

There were a few LUDs between. I do not remember exactly on each one.

Hope this detail helps. You should look at your I-485 cases if there is any LUD.

I am thinking why we were lucky this time is maybe we had pending I-90 cases. On the other side, there is more hassle with I-90 cases. They are not closed. Actually on Dec 19, we received another emails saying they had sent out RFE. The RFE refers I-90 cases but I-485 numbers are also on the letter. It asks us to send back the incorrect cards, provide the evidence of the incorrectness, blah blah, by March 2006. We feel they are kidding us.

Some more thoughts, I never know what CIS is going to do through this whole process from I-90 filing to current status. I-90 was filed in July. They were very slow to schedule Bio#1 that was done in late Sept. When Bio#1 was taken, we were surposed to give the cards and evidence back to CIS officers according to the Bio notice. But the local CIS officers refused to take them. They said they did not know what to do. I thought, well, at elast we have cards in hand so we can use although they should be backdated, no hurry, we can wait. Indeed, my wife had an emergence back home in Oct. Otherwise, we had to go to local CIS and have a stamp(?) as temp GC.

Another thing, although we did Bio#1 (I hate it) and new picture was sent alone with the blue letter, the new correct GC still use the same picture as the one on the old incorrect card. You never know.

qlyus,

Thank you for the detailed clarification ! So you didn't attach your incorrect GC card in your original I-90 because it was online application ( You sent it back only after they requested for that - the blue letter ) ?

Also, did your wife ( I assume she is derivative AS ) back CoP using renewed NP or RTD and no problem when returning ?

Some forum members suggested not to renew or back CoP immediately after GC granting. However, since our GC is always one-year backdated, how can we define the time gap about this " immediately after approval" ?

Thank you.

I did not sent the cards when filing I-90 online. I sent a few evidence documents a few days after filing. But they were returned and CIS told in the letter that we were supposed to submit incorrect cards and evidence when the Bio was taken. The Bio officers refused to take anything. Then, the blue letter came.

My wife went back CoP with renewed NP which had expired for many years. She had to renew it because the CoP does not accept RTD or RP. No question asked when came back to US.

I read discussions of returning CoP here. I personally believe USCIS does not care about it. It really depends on what your CoP will do to you and if you have guts to go back.

Thank you, qlyus, very clear. I think your wife was lucky for being able to renew NP ( Just today another thread said India gives hardtime when renewing AS's NP ). Also, I believe CIS doesn't care if you come back to CoP immediately after GC granting because when you are approved, you are already in PR for one year.

Thank you folks. Suddenly, yesterday the corrected GC came in the mail - when I least expected it. It had the correct one-year backdating :-)

Thanks all!!

Lee, good for you !

Looking your time line you got GC ( no backdating ) in June 2005, did you wait until Nov to file for your I-90 replacement ?

GrassRoot,
Yes, I did wait until Sept/Oct actually before I filed the I-90. For no reason other than laziness.
