My Canadian spouse has been working legally in the US for over 10 years under TN status. He has acquired 40 credits/quarters of work and is thus eligible to use the I-864W (we are preparing to file for an AOS based on his marriage to me, a USC).

The I-864W gives very little information about what evidence can be used to show he earned the 40 credits/quarters. We have a certified earnings statement from the SSA, but it only lists how much money he made in the past 10 years. We have the annual Social Security statement that is mailed out each year, but it only states, "You have earned enough credits to qualify for benefits....." and doesn't say "You have earned 40 credits/quarters."

What will USCIS accept as proof that the intending immigrant has earned those 40 credits/quarters? Any help or advice would be greatly appreciated. I am considering having him go to the SSA office and ask for a letter on SSA letterhead stating he has earned the 40 credits/quarters but no clue if they will do that.........

Please help! (We would like to use the I-864W because I am a stay at home mom and have no income....)

Just send a copy of his latest Social Security statement with the I-864W, and USCIS will figure out the rest.

That they're not going to base the I-864W decision solely on the evidence you send them; they're going to cross-check with the Social Security Administration. Notice that part 3 has a sentence saying that you authorize the SSA to release information to USCIS.
