i-864 using a joint sponsor

Hello,

I am applying for Permanent Residence here in the US, my wife is sponsoring me, however her annual income (plus assets divided by 5) is only $13500. The 125% poverty line for her household size of 2 is $18387. This leaves us short by $4887. My questions are:

1. How much money does a joint sponsor have to earn to cover this difference, assuming that the joint sponsor has a household size of 4? (125% poverty line for a household size of 4 is $27937)

2. Can i use my own assets? (money in my overseas bank account)

3. Can i use my own earnings from the last 12 months, even though i havn't paid taxes on these earnings?

1. Unless the joint sponsor qualifies as a "household member" according to the I-864A instructions, they have to earn enough to cover the whole amount without combining funds with the primary sponsor (your wife). You will be added to the joint sponsor's household size.

2. Yes, you can use your assets and also your wife's assets to offset the income requirement. Every $5 of assets reduces the income requirement by $1. So you would need 5 times $4887 = $24435 of assets (yours + your wife's assets combined).

3. You can only use legal income to count towards satisfying the income requirement. Which means you must have some form of work visa or employment authorization, and be paying taxes on the income.
