I-864 Question

Hello All,

I'd appreciate any input regarding my situation below:

I'm applying GC through marriage.
My spouse is currently unemployed and will not be able to be my sponsor on the I-864 form. His sister is willing to be a joint sponsor, so she is filing out a I-864 form. I'm currently on H1B visa, and will continue my employment after GC. I understand that as an intending immigrant and a spouse of petitioner, I can also use my income to support myself.

My questions are:
1. Do I need to fill out any I-864 form as well? If not, do I need to fill out any form at all?
I read instruction on I-864A form and it says that as a spouse and if the intending immigrant does not have any dependent (I don't have any dependent), do not fill out form I-864A.

2. If as an Intending immigrant, I'm using my income to support myself, and I have another person filing out I-864, how many joint sponsor(s) are there in my case?

I'd appreciate the inputs...

If you are making enough money to go over 125% poverty limit for 2(?) people then you are good and don't need a sister. You use YOUR income on 864. Your hubby is the one, who fills 864 (whether he has any income or not), because he sponsors you for the green card.

Thank you.

I-864 from petitioner (hubby) question# 25 asked you to check 2 box (with one optional). Since petitioner does not have income, no tax return was filed; I understand that he would then need to submit explanation of why no tax return filed. My question is, do we leave question #25 unchecked or check them and attach my tax return documents?

We filed jointly for 2008 tax return. Petitioner did not have any income.
Question #25 asked "My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent three years was:"

Do I put our combined income for 2008 since we filed jointly?

Appreciate the input.
