I-864 or I-134

Hi,

I am wondering if I need to file I-864 or I-134 for my spouse.
I have applied in EB2-NIW, I have H1B status, my spouse currently has F1 (OPT) status and applied for H1B.

I am not sure which form to fill up? What everyone is doing?

Imli have u seen my other post you can send i485 to either NSC or TSC

Hi raonj1, Thank for your reply. Yes, I saw that. But it was dated Jun 21 (or something like that) and there is a another instruction issued on July 30.

Also, which form did you prepare for the support of your spouse? I-864 or I-134?

If u check th pdf file it is judt released bu uscis yesterday which says NSC or TSC. I am thinking about i134 as right now my wife is on h4 and sitting home. If your wife is working u dont need to show any support. i134 says that I will support my dependent for three years and I have been here for more then 3yrs so it is technically unclear weather in present situation do I need it or not

From i864 instruction:
Employment-based preference immigrants in cases only
when a U.S. citizen or lawful permanent resident relative
filed the immigrant visa petition or such relative has a
significant ownership interest (five percent or more) in the
entity that filed the petition.
 
I thought some one might be interested in seeing what is minimum salary should be to be on safer side for GC

Thanks for your reply. My wife is working (F1-OPT) and applied for H1B (not approved yet).

I think, the counting of "3 years" starts from the date of your I-485 application. But not sure.

I am not sure what F1-OPT is But if she earns then u don't need to file i134 then again it doesn't hurt to file i134;)
