Does anyone konw if scholarship can be considered a income?
We are filing AOS and my partner's total income would exceed the 125% of poverty line with scholarship included. just pure income from work wouldn't meet the minimum.
any help?

How could you determine that how much money is needed to cross poverty line. I am sure that scholarship money can be counted.

Since scholarship money is not taxable, it cannot be counted as your income. Scholarship money is NOT AN INCOME. It is money granted to you by government or organization to use towards your education. There is a difference between income and grant. Similarly, food stamps, WIC etc cannot be counted as income. Alimony, however, counts towards your income.

Thanks

it is included in federal tax form as a part of total income.
Then do I need to substract the scolarship total from the total income?

If the scholarship is in a form of assistantship stipend, where you work (teaching or research) to earn it -under CIS authorization and I20 terms- it is indeed a form of income. You may include that in the I864A form as a sponsored immigrant/household member. However the requirement is that you should have been with your sponsor in the same household for at least 6 months. You may not sponsor yourself directly!
