I 864 household/address questions.

Greencardman

New Member
Hi, my mom's sponsoring me for a Green Card. She is my primary I 864 sponsor, while my sister is my secondary I864 sponsor.
1)My mom and sister do not live at the same address, but can my mom still use my sister's address as a residence?
2)As for my sister, she's having trouble completing her I 864.
In Part 3 (Information on immigrants you are sponsoring) Question#1, which box should my sister check? Yes or No? (She is the secondary AOS sponsor, but my mom is the Green card sponsor.
In question 7 (enter the total numner of immigrants you are sponsoring) should she write 1? My mom is my Green card sponsor. My sister is my secondary AOS sponsor.

3)In Part 5 (Sponsor's household size) Question#8 (Household size) what should she say? 1 or 2? This question is predicated on Part 3. My sister lives alone so I assume she should say "1", but since she needs to add up the "1" from Part 3 question#7 it adds up to "2." This is confusing.

If my mom uses my sister's address in my mom's I 864 is it ok even though they do not live together? The above questions for my sister's I 864 form seems to depend on what my mom says about her address, but the problem is that my mom is living in both USA and her home country, so her US address is being rented out at the moment.
Thanks

Is your sister acting as a "household member" of your mother (the sponsor)? or is she acting as a "joint sponsor"? For "household member", your sister needs to live in the same house as your mother or be her dependent on tax returns, and she combines her income with that of your mother, the sponsor. For "joint sponsor", it can be any permanent resident or citizen, and they cannot combine their income -- the joint sponsor must themselves (along with their household, if they have any) have enough income to meet the requirements.

Since your sister does not live in the same house as your mother and probably isn't your mother's dependent, I assume she can't be your mother's "household member". So I will assume your sister is being a "joint sponsor". In this case, your sister and your mother will each fill out an I-864.

It should be Yes. "No" is only applicable in cases of 2 joint sponsors, which is extremely rare, and can only happen in cases of multiple immigrants.

It's 2 -- your sister, plus the immigrant. That's unless your sister has dependent children or other people she claims as dependent on her tax return.

I think she can use your sister's as the mailing address, but list her real address as place of residence. The questions do not depend on what your mom says about her address. Even if your mom and your sister were living together, your sister can still be a joint sponsor, and your sister does not have to include your mom in her household if she does not include your mom in her tax return and is not using your mom's income to meet the requirements.

Thanks. My sister is a joint sponsor. Not a household member.
