Hi,

Re: Question 22

My wife (sponsor) has an incorporated business (corporation) and we don't know if she should check that she's employed or self-employed. I-864 instruction says that if a sponsor is self-employed she should send also an individual tax returns schedule C where profit and losses are shown. However the schedule C on our tax returns is all zeros because the profit and losses are reported on our corporation tax returns.

What I think is that she should check employed because she received W-2s and K1 dividends and she's an employee of her own company. However I'm not sure.

Please help.

Thank you all.

In either circumstances it is construed as self-employed, i.e. filing schedule C or floating S corporation to do business and taking K1, You might want to check both self employed as ... and employed as ....
